1. Acceptance of Terms

By downloading, installing, or using the EarBuddy application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and EarBuddy ("we," "our," or "us") governing your use of the App.

2. Description of Service

EarBuddy is a Bluetooth audio management application for Android devices that automatically routes audio to your preferred Bluetooth devices based on customizable priority lists. The App provides:

• Automatic Bluetooth audio device switching
• Separate priority management for calls and media
• Background service for continuous monitoring
• Device connection status tracking

3. License and Restrictions

3.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal Android device for your personal, non-commercial use.

3.2 Restrictions

You agree not to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove any proprietary notices or labels from the App
• Use the App for any commercial purpose or for any public display
• Attempt to gain unauthorized access to any portion of the App
• Use the App in any way that violates any applicable laws or regulations
• Distribute, sell, lease, or sublicense the App to any third party

4. Payment and Refunds

4.1 Purchase

EarBuddy is available for a one-time purchase fee through the Google Play Store. All payments are processed by Google Play, and you agree to their terms of service and payment policies.

4.2 Refunds

Refunds are handled according to Google Play's refund policy. Generally, you may request a refund within 48 hours of purchase. After this period, refunds are at our discretion and will be considered on a case-by-case basis.

5. User Responsibilities

You are responsible for:

• Maintaining the confidentiality of your device and Google account
• All activities that occur under your account
• Ensuring your use of the App complies with all applicable laws
• Properly configuring your device's Bluetooth settings
• Understanding that audio routing depends on your device's capabilities and connected Bluetooth devices

6. Privacy and Data

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to our collection and use of information as detailed in the Privacy Policy.

The App uses Google Firebase services for crash reporting, performance monitoring, and analytics to improve app stability and user experience. Your personal preferences and settings are stored locally on your device.

7. Disclaimers and Limitations of Liability

7.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 No Warranty

We do not warrant that:

• The App will meet all your requirements
• The App will be uninterrupted, secure, or error-free
• The App will work with all Bluetooth devices or Android versions
• Any defects in the App will be corrected

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EARBUDDY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any claims arising from or related to these Terms or the App shall not exceed the amount you paid for the App.

8. Indemnification

You agree to indemnify, defend, and hold harmless EarBuddy and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

9. Modifications to the App and Terms

9.1 App Updates

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

9.2 Terms Updates

We may revise these Terms from time to time. The most current version will always be available within the App. By continuing to use the App after revisions become effective, you agree to be bound by the revised Terms.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

11. Governing Law and Disputes

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which EarBuddy operates, without regard to its conflict of law provisions.

11.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy and License Agreement, constitute the entire agreement between you and EarBuddy regarding the App.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12.3 Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
